Kmart and Sears Merger Essay

Kmart had been established in 1962 by its parent company S. S. Kresge as a discount department store offering the most variety of goods at the lowest prices. Un- like Sears, the company chose not to locate in large shopping malls but to establish its discount stores in highly visible corner locations. During the 1960s, ’70s, and ’80s, Kmart prospered. Retail formats in operation Kmart – is a chain of discount stores that are usually free standing or located in a strip malls. Big Kmart – signals a different kind of Kmart. These stores are bigger, brighter and offer big savings, big value, big selection and big convenience. Big Kmart stores are designed to increase store sales by increasing the frequency of customer visits. The format focuses on three distinct businesses – home fashions, children’s apparel and consumables – and features an expanded food area known as the â€Å"Pantry†. Kmart Super Center – is a chain of hypermarkets that carry everything a regular Kmart carries, but also have a full grocery section with meat and poultry, baked goods, a delicatessen, garden produce, and fresh seafood. Most Kmart Super Centers operate 24-hours a day and offer special services. In 1999 Kmart began offering a dial-up internet service called BlueLight, which was eventually spun off as an independent company. BlueLight was initially free and supported by banner ads. BlueLight dropped the free service in February 2001 and was reacquired by Kmart in July 2001. In 2002 United Online, which also owns NetZero and Juno, bought the BlueLight service after Kmart filed for bankruptcy. In August 2006, Bluelight dropped the banners. As of August 2006, the service costs $14. 95 a month and has around 165,000 subscribers. Promotional Pricing model Promotional pricing had always been the forte at Kmart. Offering a lower price temporarily in order to enhance the effectiveness of product sales efforts to cost sensitive consumer. In 1990, Wal-Mart overtook Kmart in sales, they tried to wean the company away from this strategy. Kmart cut process on 38,000 items and promoted the with expensive television commercials, which failed to lure younger shoppers. Then Wal-Mart countered by using its greater efficiency and economies of scale to fight back on pricing. The outcome was 1% drop in Kmart’s sales in December and 8% increase in those of Wal-Mart. Financial Analysis Prior to 2001, company was making continues losses, in order to understand scenario; we first analyze the period from 1995 to 1998. Here, Kmart started making some profit. And the second part from the year 1998 to 2002, where they actually went bankrupts. In 1995, the firm suffered a huge loss of $571 million. This was because of the non-performance of 127 international stores. It was in the same year that COGS as a percentage of sales were too high as 78%. Operating expenses as a percentage was in proportion to that of the industry. However due to the low performance of the international stores, stores outside t United States, Kmart had a bad financial year in 1995. It was the same year that the management decided to do away with the non preforming stores and thereby closed all its international stores and started four new stores in the home market. The list of stores by Kmart during the period can be seen as under: In 1999, COGS was 78% of sales as compared to 72 % of sales in the year 1998. Also, COGS increased drastically compared to increase in sales. Sales in 1999 increased by 6. 26%, however COGS increased by 12. 23%. Thus, there was a major decrease in the grow profit from 27% of sales to 21% of sales. This was the beginning of the downfall of Kmart. From here on, COGS kept on increasing. In 2002 COG reached 85%, thus gross margin reduced from 21% in 1999 to 14% in 2002. During the same time, Kmart’s operational efficiency too decreased and it increased from 18% in the year 1999 to 21% in 2002. Thus, increase in the COGS, lowering of the gross margin and increase in the operational costs, all contributes to the fall of Kmart. Competitors within the industry Its primary competitors were Wal-Mart, Sears, Target, Kohl’s, and J.  C. Penney, with secondary competitors in certain categories. Wal-Mart Wal-Mart followed the lower cost competitive strategy of cost leadership. According to our textbook cost leadership aims at the broad mass market and requires efficient scale facilities, cost reductions, cost and overhead control; avoids marginal customers, cost minimization in R&D, service, sales force and advertising. Therefore Wal-Mart could get following benefits: this strategy provided defense against competitors, provides a barrier to entry for new competitors and generate increased market share. Wal-Mart managed to maintain â€Å"everyday low prices† and achieve highest sales in the industry. It should be noted that Wal-Mart’s 2005 revenues exceeded that of the next ? ve U. S. retailers combined: these are Home Depot, Kroger, Sears Holding Company (which includes Sears and Kmart), Costco, and Target. Wal-Mart’s technological edge is in its logistics, distribution, and inventory control helped it reduce cost and offer customers product cheaper than its competitors. Moreover it could benefit from economies of scale. Wal-Mart also used differentiation focus strategy by creating a product and service unique to customers, according to ReferenceForBusiness. com. It could be argued that this feature is not real and just in the mind of the customer; customers believed they were being offered something special. Wal-Mart achieved this strategy by offering unique warranties and brand images. Wal-Mart customers believed they were being provided with something that they cannot find at any of the store’s competitors. Wall-mart’s value chain worked in following way: Vendors, Wal-Mart’s suppliers delivered products to Wal-Mart’s distribution center or directly to one of the stores. Wal-Mart was able to bargain for the lowest possible price because of the high volume of sales. Therefore, Wal-Mart could pass this savings to its customers. After that once the products were delivered to the distribution center, they were sorted and placed on trucks to be delivered to stores. This allows for less than 48 hour deliveries to stores and increased efficiency on trucks with backhauls. After products were delivered to the stores, they were placed on the appropriate shelf location for customers to view. Store locations were located throughout the U. S. in rural and urban towns. Moreover customers could purchase products at very low prices and have the ability to return any item. These were the key elements of Wal-Mart value chain. Overall Wal-Mart’s competitive advantage over its competitors was efficient supply chain management and lower prices achieved through maintaining low costs. Sears Sears, with the second-highest annual sales, had a strong position in hard goods, such as home appliances and tools. Around 40% of all major home appliance sales continued to be controlled by Sears. Nevertheless, Sears was struggling with slumping sales as customers turned from Sears mall stores to stand-alone, big-box retailers, such as Lowe’s and Home Depot, to buy their hard goods. Sears main competitive disadvantage was its store locations. Sears has been too slow to expand away from mall locations, industry analysts said. As Sears Chairman Alan Lacy said: â€Å"Our service and products are as good as our competitors but they’re not where our customers are. † Target Target was third in sales but second in profits, behind Wal-Mart. It used differentiation strategy and tried to offer customers quality products and had distinguished itself as a merchandiser of stylish upscale products. Targets mission statement focused on great guest service, clean stores and speedy checkouts. Along with Wal-Mart, Target had flourished to such an extent that Dayton-Hudson, its parent company, had changed its corporate name to Target. Its main focus was statically higher income consumers and early internet adopters. Target’s main competitive advantage was good customer service and quality product. This is where it creates value for its customers. Kohl’s, and J. C. Penney Both Kohl’s and J. C. Penney emphasized on soft goods, such as clothing and related items. They both chose differentiation strategy. Kohl’s concentrated on selling both private and exclusive brands which were â€Å"only at Kohl’s† as well as national brands like Nike, Adidas, Lee, Levi’s, Jockey, Van Heusen. Private and exclusive brands contributed a lot more to the gross margin as Kohl’s has significant control over the production, manufacturing and marketing expense of these brands. Keeping this in mind, Kohl’s has shifted its merchandise gradually towards this section of merchandise. In 2004, Kohl’s carried 25% in Private and Exclusive Brands, and this figure rose to 50% in 2011. Moreover it tried to provide â€Å"convenience† promise to customers – an easy and satisfying shopping experience. Kohl’s organized departments by lifestyle, added signage and graphics depicting key trends, and presented merchandise to suggest how customers can create new looks. They also continued to improve inventory management to deliver more new product more often, to differentiate line mixes according to geographic preferences, and to assure a â€Å"shelf never empty† of products the consumer desires. J. C Penney targeted moderate income customs, mainly women who as company executive said that were with, â€Å"too little time, too little money, and two little kids. † Kmart versus Competitors Kmart’s main problem was that it did not have clearly defined competitive strategy. In 2001, Kmart proclaimed a new retailing strategy that included less advertising, fewer advertised specials, and lower daily prices on many items. In short, Kmart tried to challenge Wal-Mart as the everyday low-price leader. Wal-Mart responded to the Kmart challenge with still lower prices. These new initiatives further weakened the ? nancial position of Kmart Corporation. The Kmart assault on the Wal-Mart image as the low-price leader failed, and Kmart was left with huge volumes of unsold merchandise (Turner 2003, 71–72). Kmart forgot to take into consideration that its capacity to lower prices was limited because of its poor supply chain management, often popular products would be out of stock, in some cases stored in trailors outside of the stores. Kmart was not successful in using differentiation competitive strategy either. While Wal-Mart reigned supreme as the low cost leader, Target was perceived as being a â€Å"higher quality† retailer. There was basically nothing left for Kmart. In attempt to pursue differentiation strategy Kmart updated and enlarged the stores, added name brands, however this was not successful either, acquisitions all performed poorly posting minimal net income or losses and distracted management from core business. Kmart’s main competitive disadvantages were problems in value proposition, poor supply chain/inventory management and poor customer service. It needed to choose competitive strategy suitable for it and concentrate on it.

Should People Seeking Government Assistance?

â€Å"Shouldn’t you have to pass a urine test to get a welfare check since I have to pass one to earn it for you? † That’s the question many, hardworking Americans are asking themselves. In today’s America, government aid is highly depended on. The US government has spent $498 billion dollars this year on welfare alone. Mandatory drug testing for welfare applicants is becoming a popular idea across the U. S. Many states including Alabama, Kentucky, Oklahoma and Louisiana are considering adopting laws that would require states to drug test welfare applicants.In Florida, Republican Gov. Rick Scott passed a law that required welfare applicants to pay for and pass a drug test from July through October 2011. According to the National Conference for State Legislatures, Florida was one of three states in 2011 to put a drug testing for public assistance in the books; twenty eight states in 2012 proposed similar measures. The Department of Children and Families rep orted that 108 people tested positive for drugs, while 3,936 adults showed no sign of drugs in their system.Another 2,306 people opted not to take the drug test, though the survey did not ask why they were refusing to take the test, so there is no data to show whether those people objected to the policy or had obtained employment and therefore canceled their application. In September 2011, a University of Central Florida student, with the help of the American Civil Liberties Union of Florida, sued the state over the new law mandating drug testing of all welfare applicants. A little more than a month after the suit was filed, a federal judge ordered a temporary stop to the drug testing.A bench trial is scheduled for March 2013 before U. S. District Judge Mary Scriven. Required drug tests for people seeking welfare benefits ended up costing taxpayers more than it saved. Of the 4,086 applicants who scheduled drug tests while the law was enforced, 108 people, or 2. 6 percent, failed, mo st often testing positive for marijuana. The numbers show that taxpayers spent $118,140 to reimburse people for drug test costs, at an average of $35 per screening. The state lost of Florida lost $45,780, and that’s not counting attorney and court fees and the thousands of hours of staff time it took to enforce this policy.Drug testing welfare applicants was considered unconstitutional by many citizens, they claimed it went against The Fourth Amendment. The Fourth Amendment of the U. S. Constitution provides, â€Å"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. Ultimately, these words strive to protect two fundamental liberty interests – the right to privacy and freedom from personal inv asions. The Supreme Court has ruled out a number of incidents as to what an â€Å"unreasonable† search looks like. So far, it doesn't look like a drug test to control how people on welfare spend their money. Supposedly, the mandatory drug tests are designed to reduce deficits, utilize tax-payer money more efficiently, and encourage â€Å"personal responsibility. The government now will have the power to kick people off welfare, or otherwise simply deny them welfare, should the person fail their mandated drug test. Aside from deterring these self-destructive behaviors, they believe they will also save millions of dollars because they suspect they will no longer have to subsidize the drug dependencies of a substantial amount of recipients. When Reagan became President in 1986, he began to push drug testing in the workplace, schools, and those applying for free benefits as part of the escalating war on drugs.Since then, drug testing has proliferated to the rest of society. For some businesses, it has become a major hiring tool, while for others it does not exist. For those that do use drug testing, it comes on many forms. Tests range from urine based to hair based to drug recognition experts; each test has its own strengths and weaknesses. The easiest and cheapest tests to perform are urine tests. The most basic and easiest to perform is called an EMIT test. EMIT stands for enzyme multiplied immunoassay technique and involves a urine sample from the subject.The test looks for certain enzymes that occur in the body when certain drugs are consumed. Unfortunately for employers, this test is one of the most undependable of the tests available. It can be easily beaten if the subject knows that they are being tested. Tests can be tampered with in many ways. Another urine test is the gas chromatography test. With this test the urine sample is separated into its component parts. The components are then carried by an inert gas into columns where the parts are sepa rated by their boiling temperature. Each specific compound will be identifiable from the est by its unique separation time. This test is far more reliable than an EMIT test, but there are still instances of errors when certain legal substances are present. A test that is more reliable and harder still to beat is the RIA test. RIA stands for radio immunoassay and it uses the same process as the EMIT test except this test uses radioactive iodine as the detection method rather than an enzyme. Drug metabolite levels are inversely proportional to the level of radioactive particles present. The RIA test is much more reliable and even harder to beat than the gas chromatography test.However, the U. S. Military is the only major employer using the RIA test. This is due to the fact that the RIA test creates radioactive waste as a result which is extremely difficult to handle and dispose of. The next step up from the RIA test is the gas chromatography/mass spectrometry test. This test utilizes what the gas chromatography started, except that it takes the process further. After the urine has been separated into its basic components, the mass spectrometer analyzes the components and provides exact molecular identification for them.Since this test is the most expensive and the most accurate of the urine tests, businesses will usually only use this test to confirm a positive result on the EMIT test. The next cheapest test to perform is a saliva test. Saliva tests are becoming more common due to their relative unobtrusiveness and their ability to detect drug use in a more recent timeframe, usually within one week. The biggest problem with saliva tests is that there are no nationally accepted concentration cutoffs. Also, the saliva test is better at detecting methamphetamines and opiates but is much less capable of detecting THC and other cannabinoids.The last test on the list is the blood test. This test requires a sample of blood from the subject which is then sent to a lab for analysis. The cost of the blood test is quite high when compared to all the rest of the tests available. Businesses that are willing to pay for the blood test are getting the most accurate test that they can subject an employee or applicant to. The only problem with blood tests is that they can only detect substances that remain in the blood for a while. If a substance is easily flushed from the blood, it will not appear on a test if the subject has not used recently.Despite their reliability, blood tests are not used often. Most of the time, similar results can be obtained using a cheaper and less intrusive method of testing. Is this all fair? Many people argue it absolutely is. After all, welfare recipients receive millions of American dollars in aid every year. It would only be fair for them to be tested to ensure the assistance is dispersed of properly. Also, many places of employment practice random drug testing. If it happens in the workforce, why would it be unfair for we lfare recipients?There are many pros and cons of this issue. The biggest positive outcome of this program is that it would discourage recipients from purchasing and using illegal drugs. This might mean they don't even need the welfare in the first place. It could also keep children and society safer. It could help lower the demand for illegal drugs on the streets. It could possibly even save the system some money; as those who are on drugs would not receive welfare. It could even create new jobs for people to run the drug testing.However, there are many cons of mandatory drug testing for people on welfare as well. One of the biggest negatives is that it is costly. Illegal drug testing is not cheap. It could cost hundreds of thousands of dollars, even if just one of every five recipients was tested. However, this may be rationalized by saying that the cost that drugs have on our society in general would be lowered. Another negative is that some people who are on prescription medicati on could show false positives, and be discriminated against, even with a doctor's involvement.

The Issues Of The Miscommunication Cultural Studies Essay Among the problems faced to modern culture, there is one that is gradually becoming a defining factor in cross-cultural relations. The speech is going about miscommunication that is more and more form the style of the cultural processes of modernity. Miscommunication as the opposite side of understanding is one of the measurements in the process of communication between different cultures. However, the global conflict of cultures, witnesses, accomplices and the judges of which we are was generated by the lack of understanding of an unprecedented scale and intensity. And this lack of understanding beneath our eyes becomes more important in comparison to all other dimensions of communication within different cultures. I would like to discuss the problem of miscommunication in this project and use my own experience as an illustration of a communication breakdown between myself and a person from another culture. The main goals of my project are to explain and discuss how cultural miscommunication influences on our life, and to prove a thesis that miscommunication between different cultures and nations could be overcame through the specific knowledge and respect to a person whom we are communicating with. First of all in the frames of this paper it is necessary to mention that real conflict takes place under special circumstances: in a state of globality. The state of globality is characterized by the activity of an already established and effective global society, where the contours of conventional cultures are broken. Actually, no culture, ethnic group, nation, country or group of countries can no longer pretend that it is separated from the rest of the world and its affairs are internal problems that do not relate to any of the foreigners. It turned out that there are no foreigners at all: theyre gone in the sense that the culture had lost its previous, well-defined boundaries, and therefore alien and own largely mixed up, changed its previous topology and geography. In the modern world ethical issues, and, in particular, issues of ethnic identity and ethnic prejudice achieved its culmination: the linguistic, cultural, status and other differences have become a stumbling block for the peaceful coexistence of many ethnic groups. Defining the term miscommunication we should say that according to Gudykunst (2003), As serious psychological barriers in the process of cross-cultural communication the so-called ethnic stereotypes acts as relatively stable representation of the moral, mental, physical and other qualities of the representatives of different ethnic communities. Every person is a member of a certain ethnic group, and he or she consciously or subconsciously divides all people into ones own (belonging to the same ethnic group) and outsiders (members of other ethnic groups). According to Gumperz ( 1982) we see that on the verbal level culturological sign of somebodys own or someone else is manifested in the semantics of the various nominative units: lexemes, phraseological units, syntactic structures, proverbs, small-format texts (for example, anecdotes and jokes). Thinking about my own communication breakdown with a person from another culture I should say that it was connected with one dialogue misunderstanding. The person whom I communicated with was sure that only old people could be good advice-givers and young people should only listen to them and have no right on own decision of the problem. In that moment I forgot about cultural differences between us (my opponent is a Muslim and they respect old people more than other nations) and tried to prove that every person should has a right on own opinion and it is not a right position always only to listen to somebodys words. Thus, it was the hot debate between us and as a result each of us was disappointed and even upset about result of our conversation. Only now I understood that both of us were wrong, because we used different cultural languages and we made several mistakes in our conversation. I would like to say that this example of miscommunication is rather simple, and it even has an or dinary character, but exactly such simple situations lead in future to hard consequences, when one cultural groups consider other groups bad educated and rude. Thus, I would like to look on this problem of cultural miscommunication through the prism of my new knowledge about this question and demonstrate a solution for this situation. In the beginning of this part of my project I would like to say that all people should work for constructive dialogue between each other. It is a well-known fact that the entire history of humanity is a dialogue. Dialogue permeates our whole lives. It considers a tool for the implementation of communication links, the condition of mutual understanding. Fitzgerald (1996) admitted that the interaction of cultures and their dialogue is the most favorable ground for the development of interethnic and international relations. Conversely, when the society feels inter-ethnic tension and even, ethnic conflict, the dialogue between cultures is difficult, the interaction of cultures may be limited in the field of inter-ethnic tensions of these nations, bearers of these cultures. I understood that processes of cultural interaction are more complicated than we naively once thought; it was a theory that cultural dialogue is nothing more than simple transfer of the achievements of a highly devel oped culture in the less developed, which in its turn logically leads to the conclusion of the interaction of cultures as a source of progress. Now is actively studied the question of boundaries of culture, its core and periphery. I like Ting-Toomey (1999) words who said that à ¢Ã¢â€š ¬Ã‚ ¦ These words forced us to stop be rude and to respect other people. On my opinion every person should respect the point of view of another person and be patient during their communication. In my case cultural miscommunication was not only a result of different attitude to one problem, but also it was provoked by the lack of patience and respect to each other. We forgot one simple truth stated by Van Dijk (1997) who said that à ¢Ã¢â€š ¬Ã‚ ¦ Muslims are people who are marked by the culture from their birth and their specific traditions are sometimes strange for me, but it is not a reason to say that their culture is good or bad. I know that these people are different and their religion is different, but I even like them, because their historical, geographical and ethnic elements combine in an unique and original way. Thinking about my situation I have read one interesting advice about how to avoid miscommunication in future and according to Lawrence (1999) à ¢Ã¢â€š ¬Ã‚ ¦ It means that we should use the space of variations around us and think about other possibilities to interpret information in proper way. By keeping our mind free from stereotypes and open to additional possibilities of the information understanding we can prevent future miscommunication conflict from happening. Also it is necessary to add that when a person became an initiator of a miscommunication conflict the simplest thing is to say: I am sorry for the miscommunication which has lead to this situation, but the simplest way is not always the right way. On my opinion it is necessary firstly to take into account opponents cultural specificity and only then to discuss with the person some sharp questions or situations. I want also to listen to words said by Arcidiacono (2010) who thinks à ¢Ã¢â€š ¬Ã‚ ¦ Taking into account my own problem in communication and information from different readings I want to say that the first thing that should be used for overcoming miscommunication is a dialogue. Of course, at the beginning of the conversation, as it was above mentioned, it is necessary to say sorry for miscommunication and then to speak with a person in respectful and polite manner. Forthcoming manner could save many debates and dialogue is a communication with the culture, the realization and reproduction of its achievements, it is the discovery and understanding of the values of other cultures, the possibility of removing political, religious or other tensions between nations and ethnic groups. It is necessary to remember that dialogue is a necessary condition for scientific search for truth and the creative process in art. Dialogue is a way for understanding of own I-image and possibility to commu nicate with others in proper constructive way. I even think that dialogue between cultures can act as a conciliating factor that prevents the emergence of wars and conflicts. It can reduce social tensions and to create an environment of trust and mutual respect. The notion of dialogue is especially true for modern culture and it will help contemporary society to avoid miscommunication. The very process of interaction is a dialogue, and forms of interaction present different kinds of dialogic relations. The idea of dialogue has developed in the deep past. Ancient texts of Indian culture are filled with the idea of unity of cultures and peoples, macro-and microcosm, musings that human health depends largely on the quality of this relationship with the environment, from the consciousness of the power of beauty, understanding how the universe reflected in our being. Basing on my researches I came to the conclusion that the influence of one culture to another is realized only if the necessary conditions exist for such influence. Dialogue between two cultures is possible only when a certain convergence of cultural codes and the existence or occurrence of a common mentality have a place. Dialogue of cultures is a penetration into the system of values of a culture, respect to them, overcoming stereotypes, the synthesis of original and other nationalities, leading to mutual enrichment and integration into the global cultural context. In the dialogue of cultures is important to see the universal values of cultural interaction. One of the main objective contradictions inherent in all cultures is the contradiction between the development of national cultures and their convergence. Therefore, the need for dialogue between cultures is a prerequisite for self-preservation of mankind. A form of spiritual unity is the result of the dialogue of contemporary culture. To sum up, I would like to say that in this research project I have discussed the problem of miscommunication and demonstrated its solution. There were also discussed cultural differences and their influences on our life. I strongly believe that dialogue between cultures was and remains central point in the development of mankind. Throughout the centuries and millennia occurred mutual enrichment of cultures that make up the unique mosaic of human civilization. They are pre-potency, deprivation, domination, gratification and activation. Pre-potency is the strength associated with the needs. Physiological needs have greater pre-potency. Deprivation is the perception of an obstacle for satisfaction of a need. Thus, deprived need has high pre-potency. Domination is attaching importance to a need. A deprived need dominates the individual. In order to reduce dissonance associated with the deprivation, individuals try to gratify by undertaking some action. Therefore, gratification is the satisfaction of the need. Gratified need does not dominate. At the end, activation of need determine motivation. Need satisfaction activates the needs from one level to next higher levels. Maslow believes that these repeat as a cycle until the highest level need is satisfied. Based on the concept Maslow identified five categories of needs and their role in motivating individuals. They are described below: 1) Physiological Needs: Basic and primary needs required for human existence are physiological needs. They relate to biological and are required for preservation of basic human life. These needs are Identified to the human organ in the body. They are finite needs. They must be satisfied repeatedly until human beings die. They are not associated with money alone. They are hunger, thirst, sleep, shelter, sex, and other bodily needs. The proposition relating to the basic needs is that they are primary motivators to any individual and once they are satisfied, they no longer motivate. The next level need becomes important for satisfaction until the basic need is dormant. Provision of adequate monetary rewards to satisfy these needs motivate employees in organisations. 2) Safety Needs: Individuals seek protection from natural environment, biological danger, economic deprivation and emotional threat from other beings and animals. I must say that I too am a supporter of the death penalty and would be hard pressed to argue my point more convincingly than Mr. Koch. Mr. Koch mentions several points, but the three that are the most poignant are his arguments concerning the barbaric, murderous, and imperfect aspects of the death penalty. First, I do not feel that the death penalty is barbaric at all. As Mr. Koch points out, we have come a long way from drawing and quartering our criminals. Lethal injection is no more barbaric then a flu-shot. Many people are more concerned with the comfort and well being of our felons than our neighbors. What is barbaric is allowing a man to live after he heinously raped and murdered a young girl. I personally have no objection to the use of many long-forgotten methods, such as the guillotine, noose, firing squad, or headman’s axe. Specifically, murder is defined as the unlawful premeditated killing of a human being. Government-sanctioned executions, which follow the laws of the state, are not murder by this standard. Koch writes â€Å"The execution of a lawfully condemned killer is no more murder than is legal imprisonment kidnapping.† I feel this sums it up quite eloquently. Singer explains that he’s not saying both groups should be treated exactly the same, because there are differences between species, therefore they should have different rights. Singer states, â€Å"The interests of every being affected by an action are to be taken into account and given the same weight as the like interests of any other being† (LaFollette, 110). For a being to have interests, they must have the capability to enjoy life and suffer. He points out that any animal would have an interest in not being tormented, so it does not suffer. We could be sure that animals feel pain based on the fact that they show the same signs used by humans that show they feel pain. For example, if a person would to step on a dog’s tail he might bark, t he same as if a human had their hand slammed in the door they would yell. Singer brings up the issue of sexism and racism. No matter how we may try to look at it, not all humans are equal. He argues, â€Å"†¦a person’s sex is no guide to his or her abilities, and this is why it is unjustifiable to discriminate on the basis of sex† (LaFollette, 109), and the same goes for racism – basing a person’s abilities based on the color of their skin is just as absurd. Racism and sexism are both morally wrong, therefore so is speciesism. Another point the Singer brings up is how humans let their own interests take priority over other species. The fact that we eat animals shows that we  think of them as nothing more than a â€Å"means to our ends†. This is true because there are other, more nutritional, ways to meet our needs. By doing this we cause additional suffering for animals. Moreover, the cruel behavior that we put these animals through before they are killed for us to eat. Yet another type of discrimination we perform on these animals is experimentation to see the affects of substances and if they are safe on humans. Basically, animal experimentation and consumption is wrong except if we were willing to perform the same acts on a human with similar capabilities. Singer reasons that, â€Å"a full-grown horse or dog is beyond comparison a more rational, as well as a more conversable animal, than an infant of a day, or a week, or even a month† (LaFollette, 110). He argues that if we cannot experiment on humans with severe brain damage or defective infants, then we should not experiment on animals. Furthermore, killing animals for food would be the same as killing these humans for food. Singer is saying that if instead of treating these defective infants that don’t stand a chance, we should use them to test medical treatments, which in the end is the greater good for more people. The last aspect of speciesism that Singer talks about is philosophers trying to draw a distinct, clear line between the equality of humans and animals. However, in order to include all humans it would have to be a broad generalized definition, which could not go without including some animals also. Though an infant may not have superior characteristics to that of a dog, doesn’t mean that we can research on the infant; though it is looked at as quite all right to do research on a dog. Singer presents a sound argument on the rights of animals. As I have pointed out, all of his premises are true, and well backed up. For the most part I agree with his argument, except for the point he made on experimenting with infants or disabled humans. Though he did present his point well and backed it up, that just seemed to be the most controversial statement. I can understand his point of view of experimenting on a perfectly healthy animal who can feel pain, so why not a person who doesn’t have much of a future ahead, however I don’t agree with it. It comes down to quality of life. It might work as a hypothetical situation about some unknown infant, but what  family would actually give up their child for experimentation? Or even a loved one who may be disabled? There is an emotional standpoint that I think Singer needs to address. Furthermore, I agree that since there are other means of getting the nutrition that we need, people should make an effort to eat less meat. Nonetheless, people will continue to eat meat due to the fact that they ignorant as to what exactly the animals go through before they are killed for us to eat. Personally, I believe that that is how people like it. Then that way they don’t have to feel guilty every time they pick up a hamburger, and they can just go on enjoying it.
